Unifab’s contribution to the list of the most notorious “counterfeit spots”
Every year, the Office of the United States Trade Representative (USTR) collects a list of the most notorious online and physical counterfeit spots that are outside US borders. (Special 301 Out-of-Cycle Review of Notorious Markets). For example, the 2017 report mentions, inter alia, the following marketplaces: DHGhate.com (China), Indiamart.com (India), Taobao.com (China), Vkontakte.com (Russia), and the shopping mall called “Pacific Mall” in Markham, Ontario, Canada (iptwins.com, 1st Oct. 2018). As part of the 2018 Comment Request from the USTR, the Union des Fabricants (Unifab) shared the experience of its members in a letter to the USTR on October 3, 2018.
Founded in 1872, Unifab is a French non-profit association whose purpose is the defense and promotion of intellectual property rights. It brings together many companies and associations from all other the world, representing in kind of industries. The experience, the expertise and the network of Unifab make it a major player in the combat against counterfeiting on the world stage. Its contribution to the identification of online and physical markets where the counterfeit is rife is substantial and indispensable.
In its contribution to the USTR, the Unifab classifies the markets in priorities:
- Priority 1 or “blacklist”, targets particularly problematic sites, when effective measures against counterfeiting are totally or partially absent, which makes the situation alarming.
- Priority 2 or “intermediate list”, refers to markets where, despite the existence of certain measures, counterfeiting remains very visible.
- The category named “to be monitored” brings together markets that do not deserve to appear in Priority 1 and 2 lists, but which nevertheless need to be monitored.
This classification forms the result of the application of a number of criteria, including the following:
– the traffic and popularity;
– the revenues;
– the estimated volume of counterfeit on the market’s scale;
– the categories of counterfeit goods;
– the estimation of the economic harm caused to the intellectual property rights holders;
– the involvement in the fight against counterfeiting;
– actions, litigation, execution, agreements;
– actions to filter or reduce counterfeiting;
– additional actions, such as policies and procedures to prevent/remove access to counterfeits, such as deactivation of accounts;
– the effectiveness of these policies and procedures;
– the origin of the counterfeit goods.
As a result, Unifab suggests that the following websites and mobile Apps be included in the Special 301 Out-of-Cycle Review of Notorious Markets:

The Special 301 Out-of-Cycle Review of Notorious Markets does not concern US companies. Accordingly, there will be no mention of eBay (although the US authorities regularly perform actions on counterfeit cases in relation with sales on eBay: iptwins.com, June 25, 2018; iptwins.com, August 27, 2018), SunFrog.com (the platform was recently condemned to nearly $ 20 million for counterfeiting: iptwins.com, June 27, 2018), or even Amazon.com. However, like Frères Maus (iptwins.com, Nov. 15, 2018), Chanel (iptwins.com, 16 nov. 2018), and more subtly, the American Apparel & Footwear Association (AAFA) (iptwins.com, Oct. 19, 2018), Unifab also refers to American websites and shopping centers.
