Oh claim (and watch) for me TMCH …

2013/12/12: The Trademark Clearinghouse will extend the Claims Notifications from 90 days (after the Sunrise period) to an indefinite period.

The decision to extend the claims service has been made in response to market demand by IP holders for an open-ended notification solution. The service will only be available to trademark holders recording marks into The Trademark Clearinghouse and comes at no additional cost. The service is however non-mandatory, leaving each trademark holder to decide whether they wish to sign up for the ongoing claims notifications services.

As you know, under the Claims Notification procedure, the Clearinghouse will notify the Trademark holder or the Trademark Agent when a third party registers a domain name that is I D E N T I C A L to their trademark recorded in the Clearinghouse.

The service which will be launched in the course of 2014 will be a great help for identifying identical registrations, but does not replace the need for a similarity search which is the only way to identify registration of variations around your trademark as domain names.

IP Twins will keep you updated in that respect too.
